I. Identity and Domicile of Responsible Entity

Pan-American México, Insurance Company, S.A. de C.V. (from hereon “the Company"), is an authorized Insurance Company by the Ministry of Treasury and Public Credit (Secretaría de Hacienda y Crédito Público) established according to the laws of the United States of Mexico, domiciled at Av. Paseo de la Reforma 412 suite 1501 Colonia Juárez Delegación Cuauhtémoc, Postal Code 06600 in Mexico City,. The Company is responsible for the use of directly collected personal information derived from its legal relationship with You, through our Insurance Agents or any third or responsible party that must transfer with the Company your personal information to comply with any obligations. The aforementioned information may be shared electronically or by optical, audio, visual or any other type of technology or media.

II. Personal Information Collected

The Company collects and uses the following information: gender and identifying information; contact and address information; employment information; financial information; educational information; transit and migratory information, as well as information pertaining to legal and administrative issues. Additionally, based on the type of insurance, we collect Sensitive Information relating to the following categories: medical conditions; behavior and conduct, and physical characteristics.

III. PRIMARY purposes

Any personal information collected shall be used to: verify identity; evaluate insurance applications and covered risk selection or determine coverage in a Collective Insurance Plan; determine applicable premiums and deductibles for the requested coverage; determine type of coverage required; issue, maintain and renew an insurance Policy through our commercialization network; process, reimburse or review losses; contact family members in case of emergency; ask for references, answer questions, research and review any losses, claims and/or complaints; provide services derived from the insurance policy or policies through the Company’s provider network; prevent fraud and detect any potentially illicit transactions; collect statistical data, and comply with any Company obligations and rights established by applicable Insurance Contract Law, Insurance and Bonding Companies Law or any other legislation.

IV. SECONDARY purposes

Your personal information can be used to offer and promote goods, products and services and/or for marketing or research purposes by the Company or any of its affiliates offering complementary services or products related to the Company’s trade as long as you grant your consent for such purpose as stated in section XIV of article 294 of the Insurance and Bonding Companies Law.

V. Personal Information Transfers

The Company will notify you if it transfers any personal information to other third parties for the PRIMARY purposes described in this Notice. In this case, the Company will transfer the information to service providers (for service, loss review, and policy management purposes), Insurance Agents and commercialization network (for issuance, maintenance, renewal and other services related to the policy), Government, legal or regulatory agencies (for compliance with any applicable norms, statistical studies, fraud prevention and detection of potentially illicit transactions), other Insurance Companies and Insurance Companies Associations (for membership, research, compensation and fraud prevention purposes.)

Additionally, the Company can transfer your personal information to third parties for SECONDARY purposes stated in this Notice, for which we have your implied consent, unless you state your objection to such disclosures when you acquire the Privacy Notice, at the time when information is collected personally or directly, or, by sending an email notification to the Company’s Privacy Officer.

If the Company shares any financial or sensitive personal information for SECONDARY purposes or for any purpose not stated in this Notice, the Company will notify you and obtain your written or implicit consent, as required.

VI. Exercising "ARCO" Rights

You may send the Privacy Officer the form; Exercising ARCO Rights; (downloadable from the following site: or available from our offices), along with the required accompanying documentation, to request, directly or through a representative, that the Company: Access, Rectify or Cancel any proprietary personal information, as well as Oppose any treatment.

Exercising ARCO rights allows you to request the following from the Company:

i) Access – The owner of the personal data may request access to any personal information used by the Company. The Company can provide you printed copies or an electronic file with your information.

ii) Rectify - The owner of the personal data may request the Company to correct personal information entries, and must provide supporting documentation for such changes.

iii) Oppose - The owner of the personal data can be opposed to the use of his/her personal information for certain purposes, understanding that using information for PRIMARY purposes may be essential for the Company to comply with contractual requirements and any applicable laws.

iv) Cancel – The owner of the personal data may request that the Company remove his/her personal information, as long as such information is not currently used in an already established relationship with the owner and the Company does not have legal obligations that require continued handling of the information for a set period of time. It is important to keep in mind that the Company may not be able to cancel access to personal information until it is permitted by any applicable laws.

The exercising of ARCO rights shall be carried out for free; however, the Company may collect payment from the owner only to cover justifiable expenses for reproducing or mailing the requested information.

Once an application has been submitted and all required documentation is complete, the Company will notify the owner, within a maximum of 20 (twenty) days following the request, the response of the Company, in which case, if approved, will become effective within the next 15 (fifteen) days from the date of response.

VII. Means for limiting the use and disclosure of personal information

In all instances in which use of your personal information is essential for any activities and responsibilities inherent to the Insurance Contract and for compliance with any legal requirements to which the Company is subject, it is not possible to limit the Company’s use of such information for PRIMARY purposes, as established in this Notice.

Notwithstanding, to limit the use or disclosure of personal information for SECONDARY purposes, as established in this Notice, an email must be sent to the Company’s Privacy Officer to the following address

When personal information is collected through electronic means (Internet), the Company can automatically extract any information that it deems necessary for statistical and marketing purposes.

VIII. Revocation of Consent

You may revoke the consent you have granted us to handle your personal information, by sending an email to the Company’s Privacy Officer, understanding that revocation of consent will mean that we will terminate our services and the legal relationship you have with the Company; thus, cancelling the Insurance Contract.

IX. Limiting the use of Personal Information

In order to limit the use of personal information for Secondary Purposes, you may request that your information be included on the Company’s exclusion list.

X. Security Measures

The Company uses administrative, technical and physical security measures to protect your personal information against damage, loss, alteration, destruction or unauthorized use or access and verifies that any third party that uses this information respects this Privacy Notice.

XI. Means for distributing Privacy Notices and Modifications

This Privacy Notice, as well as any modifications, will be available in the website and other communications in our offices, in addition to other methods of communication that might be available to you.
